Terms of Service

These Terms of Service ("Terms") govern your use of Mally and any services provided by us. By accessing or using Mally, you agree to be bound by these Terms.
1. The service
Mally provides white-label email and SMS marketing infrastructure. Agency customers receive a dedicated deployment on infrastructure managed by Mally. Business customers use the shared hosted platform at mally.io/app. The specific features and limits of your plan are as described at the time of purchase.
2. Accounts and licence keys
Agency deployments are activated via a licence key issued by Mally upon confirmation of payment. Licence keys are tied to a single domain and may not be transferred, resold, or used on additional deployments. You are responsible for keeping your licence key secure.
3. Payment and billing
Setup fees are non-refundable. Monthly or annual subscription fees are billed in advance. Failure to pay within 14 days of a failed charge may result in suspension of the service. Annual subscriptions are non-refundable after the 14-day cancellation window from the billing date.
4. Acceptable use
You may not use Mally to:
- Send unsolicited bulk email (spam)
- Distribute malware, phishing content, or fraudulent material
- Violate any applicable law or regulation, including CAN-SPAM, GDPR, or CASL
- Resell or sublicense the platform to third parties without written permission from Mally
- Reverse-engineer, decompile, or attempt to extract the source code
We reserve the right to suspend or terminate accounts that violate these terms without prior notice.
5. Tenant license restrictions
The Mally Tenant License grants you the right to operate one deployment on one domain/TLD only. You may not use the license on additional domains, subdomains acting as separate products, or transfer it to a third party. Resale of access to the licensed platform as a white-label product to your own clients is permitted provided you comply with these Terms.
6. Service availability
We aim for 99.5% uptime but do not guarantee uninterrupted service. Scheduled maintenance will be communicated in advance where possible. We are not liable for losses arising from service interruptions outside of our reasonable control.
7. Data and privacy
Your use of subscriber data must comply with applicable privacy laws. You are the data controller for subscriber data stored in your deployment. Mally acts as a data processor and handles data only as directed by you. See our Privacy Policy for details.
8. Limitation of liability
To the maximum extent permitted by law, Mally's total liability to you for any claim arising from your use of the service is limited to the fees you paid in the 3 months preceding the claim. We are not liable for indirect, incidental, or consequential damages including lost revenue or data loss.
9. Termination
You may cancel your subscription at any time. Cancellation takes effect at the end of the current billing period. Agency deployments are decommissioned 30 days after cancellation — you are responsible for exporting any data you require before that date.
10. Changes to these terms
We may update these Terms. We will notify you by email at least 14 days before material changes take effect. Continued use of the service after that date constitutes acceptance of the updated Terms.
